Terms of Service — The Promotability Score™

Please read these Terms of Service ("Terms") carefully before purchasing or using The Promotability Score™ (the "Tool," "Service," or "Product"), owned and operated by Sheena Hakimian, a sole proprietor ("we," "us," "our").

By purchasing access to the Tool, you ("you," "user," "customer") agree to be bound by these Terms. If you do not agree, do not purchase or use the Service.

1. What You're Buying

The Promotability Score™ is a self-guided, AI-generated career assessment tool. For a one-time payment of $27, you receive:

  • Access to the assessment tool for 90 days from the date of purchase
  • Up to 3 completed assessments per rolling 30-day period
  • A personalized report generated by AI, including a score, pillar breakdown, strengths/blind spots, a 30-day action plan, and suggested scripts

This is a digital, self-serve product. It is not 1:1 coaching, therapy, legal advice, financial advice, or a guarantee of any specific career outcome.

2. No Guarantee of Results

The Promotability Score™ is designed to give you insight and a personalized action plan based on the information you provide. We do not guarantee that using this Tool will result in a promotion, raise, new job, or any other specific career outcome. Career outcomes depend on many factors outside our control, including your employer, industry, timing, and how you choose to apply the guidance provided.

The report is a diagnostic and planning tool — not a promise.

3. AI-Generated Content

Your report is generated using artificial intelligence (currently Google's Gemini model, accessed via a third-party AI platform). This means:

  • Your answers to the assessment questions are processed by an AI system to generate your personalized report.
  • While we've designed the assessment and prompts carefully, AI-generated content can occasionally be inaccurate, generic, or not perfectly tailored to your situation. Use your own judgment when applying any recommendation.
  • The Tool is not a substitute for professional career counseling, mental health support, legal advice, or financial advice. If you are dealing with a serious workplace, legal, or mental health issue, please consult an appropriately licensed professional.

4. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase or use this Service. By using the Tool, you confirm that you meet this requirement.

5. Payment & Access

  • Payment is processed at the time of purchase through Kajabi.
  • Access begins immediately upon successful payment and lasts for 90 days.
  • You may generate up to 3 assessments in any rolling 30-day window during your access period.
  • Access is tied to the individual account/email used at purchase and is not transferable.
  • After your 90-day access period ends, you may be offered the option to renew or repurchase access; continued access is not guaranteed at the same price.

6. Refund Policy

Because this is a digital product delivered instantly upon purchase, all sales are final. We do not offer refunds once access to the assessment has been granted.

7. Intellectual Property

The Promotability Score™, the Four Pillars of Promotability™ framework, the 3 See's of Personal Branding, all assessment questions, report templates, and associated branding are the intellectual property of Sheena Hakimian. You may use your personalized report for your own personal career development. You may not resell, redistribute, copy, or repurpose the assessment questions, framework, or report structure for commercial use.

8. Acceptable Use

You agree not to:

  • Share your login/access with others
  • Attempt to reverse-engineer, scrape, or extract the underlying assessment logic or AI prompts
  • Use the Tool for any unlawful purpose
  • Submit false information about another person without their knowledge, or use the Tool to assess someone else without their consent

9. Limitation of Liability

To the fullest extent permitted by law, Sheena Hakimian and any employees or contractors are not liable for any indirect, incidental, or consequential damages arising from your use of the Tool, including but not limited to career decisions made based on your report, employment outcomes, or reliance on AI-generated content.

Our total liability to you for any claim arising from these Terms or the Service is limited to the amount you paid for the Service ($27).

10. Disclaimer of Professional Advice

The Promotability Score™ provides general career development guidance based on a proprietary coaching framework. It is not:

  • Legal advice
  • Financial advice
  • Psychological, psychiatric, or medical advice
  • A substitute for advice from your own HR department, employment attorney, or licensed professional where applicable

11. Changes to the Service or Terms

We may update these Terms, the Tool's features, pricing, or access limits at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.
